Lawyer off case

MOORE — Oklahoma City attorney Michael Brooks-Jimenez confirmed last week that he is no longer representing the family of Luis Rodriguez, who died earlier this year after a clash with members of the Moore Police Department.

“I think Mrs. (Nair) Rodriguez has decided to look for other counsel,” Brooks-Jimenez said. “I wish her well. It’s her decision. I hope things go well for her. Other than that, I don’t think I have anything else to say.”

Rodriguez, 44, died Feb. 15 after an altercation with three members of the Moore Police Department and two off-duty Oklahoma game wardens working private security at the Warren Theatre. Rodriguez’s wife, Nair, said she believes her husband was beaten to death in the process.

In April, the office of the Chief Medical Examiner ruled the death a homicide. According to the ME’s report, no drugs or alcohol were found in Rodriguez’s system, but he was diagnosed with pulmonary edema and congestion with intra-alveolar hemorrhage.

Scalp contusions and abrasions on the right forearm, hands, abdomen and knees also were found on Rodriguez.

According to reports, Nair Rodriguez believed Brooks-Jimenez was negotiating with Moore Police regarding a potential civil suit. It’s a claim the attorney denies.

“I disagree with her characterization,” Brooks-Jimenez said. “I disagree with Mrs. Rodriguez on that. Nevertheless, it’s her decision who represents her.”

The investigation into the death of Rodriguez was completed recently by the Oklahoma State Bureau of Investigation (OSBI). All evidence was then turned over to Cleveland County District Attorney Greg Mashburn to decide if charges would be filed.

Mashburn has yet to announce a decision or release the security video from the Warren Theatre, which Brooks-Jimenez said showed MPD members beating Rodriguez.

Brooks-Jimenez and Nair didn’t see the security video until last month after Nair was interviewed by the OSBI. Yet, she told a media outlet that Brooks-Jimenez should have asked for the video “weeks ago.”
